Terms of Service

1. Agreement to Terms

By accessing or using MyRental.pro ("MyRental," "the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of a company, partnership, or other entity, you represent and warrant that you have authority to bind that entity to these Terms, and "you" refers to that entity. If you do not agree, do not access or use the Platform.

These Terms incorporate by reference our Privacy Policy, any plan-specific terms agreed at the time of subscription, and any service-specific addenda we publish from time to time.

2. Description of Service

MyRental is a cloud-based, multi-tenant property management platform that enables property management companies and landlords ("Clients") and their authorized staff to manage properties, units, leases, residents, applicants, vendors, maintenance work orders, payments, document templates, e-signature workflows, and related operations. The Platform is accessed via web browser at myrental.pro. Resident-facing functionality (rent payment, document signing, work-order submission, in-portal messaging) is provided to residents on behalf of, and at the direction of, their Client.

3. Accounts and Registration

To use the Platform you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@myrental.pro if you suspect unauthorized access. We may terminate accounts that contain materially inaccurate information, that have been inactive for an extended period, or that are used in violation of these Terms.

Certain elevated account roles require, or will require, multi-factor authentication. Where multi-factor authentication is required, account access is conditioned on enrolling and maintaining a working factor.

4. Subscription, Trial, and Billing

The Platform is offered on a subscription basis. By subscribing, you authorize us, directly or through Stripe, Inc., to charge your designated payment method on a recurring basis at the rates and intervals in effect at the time of each billing cycle. Subscription fees are non-refundable except as expressly stated in these Terms or required by applicable law.

Free trial. We may offer a free trial period at our discretion. At the end of the trial period, your subscription will automatically convert to a paid plan at the then-current rates unless you cancel before the trial ends. We will send reminder notices before the trial expires; lack of receipt of a reminder does not waive billing.

Lapsed subscription. If a subscription lapses for non-payment, the Client's write access to the Platform is paused. Read access and resident-facing functionality (such as the resident portal) may also be limited. Data is preserved and access may be restored upon payment, subject to applicable retention rules.

Pricing changes. We may change subscription pricing with at least thirty (30) days' prior notice to active subscribers. Pricing changes take effect at the next billing cycle following the notice period.

Cancellation. You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. Cancellation does not entitle you to a refund of fees already paid.

5. Client Responsibilities

As a Client, you are responsible for:

MyRental does not provide legal, financial, real-estate, accounting, tax, data-protection, privacy, fair-housing, or other compliance advice or guidance of any kind. Features, templates, alerts, and informational content provided through the Platform are tools intended to assist Clients with their own decision-making; they do not constitute advice and carry no warranty of fitness for any particular jurisdiction, regulatory regime, or compliance purpose. Clients should consult qualified counsel in their jurisdiction as appropriate and are solely responsible for compliance with applicable law.

6. Cross-Company Resident Data

The Platform enforces isolation of resident records between Clients. Each Client has access only to records associated with that Client, including in cases where the same individual is a resident of more than one Client on the Platform.

7. Multi-Company Residents

The Platform supports the same individual being a resident at multiple Clients (for example, a tenant who has previously rented from Client A and currently rents from Client B). In that case, the resident's records at each Client are stored separately, scoped to that Client, and isolated from other Clients' views. The resident may use a single set of login credentials to switch between Client views in their resident portal; the underlying data remains compartmentalized per Client.

Identity-verification records, where collected, may be retained at the platform level (associated with the natural person) rather than per-Client to avoid unnecessary repetition of sensitive disclosures. Payment methods, screening reports, lease ledgers, and notes remain per-Client.

8. Acceptable Use

You agree not to use the Platform to:

We may suspend or terminate access for violations of this section without prior notice where reasonably necessary to protect the Platform, other Clients, residents, or third parties.

9. Payment Processing

Subscription billing and resident rent payments facilitated through the Platform are processed by Stripe, Inc. and, for rent collection, by Stripe Connect connected accounts established for each Client. By enabling online rent collection, you and your residents agree to Stripe's terms of service and privacy policy, which are independent agreements between you (or your residents) and Stripe. MyRental is not a party to payment transactions between Clients and residents and is not a money transmitter. We are not responsible for failed, disputed, returned, or reversed payments, ACH NSF fees, chargeback fees, or other charges imposed by Stripe or the payment networks. ACH payments are subject to NACHA operating rules.

10. Communications

You consent to receive electronic communications from MyRental in connection with your account, including transactional email (welcome, password reset, lease documents, message notifications, payment receipts, work-order alerts, and trial/billing notices). Transactional email related to maintenance and account security cannot be entirely opted out of while maintaining an active account; you can opt out of notification email at any time using the unsubscribe link in any notification email, but doing so may impair your ability to use the Platform. 11. Data Ownership and License

You retain all rights to the data, content, documents, and other materials you input into the Platform ("Client Content"). You grant MyRental a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display Client Content solely as necessary to provide the Platform to you, to comply with law, to maintain the Platform's security, and to support de-identified analytical use of operational telemetry.

MyRental and its licensors own all rights in the Platform itself — including its design, code, features, user interface, documentation, templates we author, and any feedback or suggestions you provide. These Terms do not grant you any ownership rights in the Platform.

12. Data Export and Portability

While your subscription is active you may export your data in the formats made available through the Platform (CSV, PDF, or JSON depending on the record type). On cancellation or termination, you may request an export of your data within thirty (30) days. After that thirty-day window we may, but are not obligated to, retain your data; see the Data Retention section of our Privacy Policy for current behavior.

13. Service Availability

We strive to maintain high availability of the Platform but do not guarantee uninterrupted access. The Platform may be unavailable from time to time due to maintenance, upgrades, third-party outages (including outages of our sub-processors), or events beyond our reasonable control. We will use commercially reasonable efforts to provide advance notice of planned maintenance affecting normal availability. We may modify, suspend, or discontinue any feature with reasonable notice. We are not liable for any losses resulting from service interruptions or modifications except as expressly stated below in Limitation of Liability.

Force majeure. Neither party is liable for any failure or delay in performance (except payment obligations) caused by events outside its reasonable control, including but not limited to natural disasters, fire, acts of terrorism, war, civil unrest, governmental action, telecommunications failures, internet-backbone disruption, and pandemic-related disruption.

14. Beta and Pre-Release Features

From time to time we may make beta, preview, or pre-release features available, identified as such within the Platform. Beta features are provided "as is" and may be modified, withdrawn, or made generally available on different terms at any time. Your use of beta features is voluntary and at your discretion.

15. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR TRADE USAGE. MYRENTAL DOES NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES; IN THOSE JURISDICTIONS, SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY.

Without limiting the foregoing, the Platform's compliance-adjacent features — including but not limited to document templates, compliance category trackers, jurisdiction-based filters, and configurable notifications — are provided for Client convenience only and carry no warranty that any feature, template, threshold, alert, or output is accurate, current, complete, or sufficient for compliance with any law, regulation, or contractual obligation applicable to the Client. The Client is solely responsible for verifying applicability and adequacy.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY (NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS) SHALL BE LIABLE TO THE OTHER FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE PLATFORM, EVEN IF THE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MYRENTAL'S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

NOTHING IN THESE TERMS LIMITS LIABILITY FOR (i) FRAUD OR INTENTIONAL MISCONDUCT, (ii) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR (iii) ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

17. Indemnification

You agree to defend, indemnify, and hold harmless MyRental and its officers, directors, employees, and agents from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Platform; (b) your violation of these Terms or our Privacy Policy; (c) your violation of any law or third-party right; (d) any off-platform disclosure you make of resident information, including without limitation any disclosure described in Section 6 (Cross-Company Resident Data); or (e) Client Content you upload, store, or transmit through the Platform.

18. Termination

We may suspend or terminate your account and access to the Platform at any time for material violation of these Terms (with or without prior notice as the circumstances warrant), for non-payment, or for any other reason on at least thirty (30) days' prior notice. Upon termination, your right to access the Platform ceases. Data export rights are described in Section 12 (Data Export and Portability) and retention is described in our Privacy Policy.

19. Survival

Sections that by their nature should survive termination (including Sections 6, 11, 12, 15, 16, 17, 18, 20, 22, 23, and 24) survive termination of these Terms.

20. Governing Law and Disputes

These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-laws principles. Subject to the next paragraph, any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Douglas County, Nebraska, and each party consents to personal jurisdiction in, and venue in, those courts.

If applicable law in your jurisdiction prohibits the choice-of-law or venue provisions of this Section, those provisions do not apply to you to the extent prohibited; the remainder of this Section and these Terms remain in effect.

21. Class Action Waiver (where enforceable)

Where permitted by applicable law, you and MyRental each agree that any dispute will be brought in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. This waiver does not apply where prohibited by law.

22. Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms to any successor in interest in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.

23. Notices

We may give you notice through the Platform's in-product notification system or by email to the address on file. You may give us notice by email to hello@myrental.pro. Email notices are deemed given on the day sent. In-product notices are deemed given on the day posted.

24. Entire Agreement; Order of Precedence

These Terms, together with our Privacy Policy and any addenda or plan-specific terms agreed in writing, constitute the entire agreement between you and MyRental regarding the Platform and supersede any prior or contemporaneous agreements relating to the same subject matter. In the event of a conflict, an executed written addendum prevails over these Terms, and these Terms prevail over the Privacy Policy as to interpretation of contractual obligations (while the Privacy Policy governs data practices).

25. Severability and Waiver

If any provision of these Terms is held unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. Our failure to enforce any provision is not a waiver of that or any other provision.

26. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of these Terms and notify active Clients by in-product notice or email. Where the change materially expands your obligations or reduces your rights, we will give at least thirty (30) days' advance notice before the change takes effect. Your continued use of the Platform after the effective date of an update constitutes acceptance of the updated Terms.
