Terms of Service

These terms are a working draft and should be reviewed by qualified legal counsel before MyRental.pro is made available to the general public.

1. Agreement to Terms

By accessing or using MyRental.pro ("MyRental," "the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms. If you do not agree, do not use the Platform.

2. Description of Service

MyRental is a cloud-based property management platform that enables property management companies and landlords ("Clients") to manage properties, units, leases, tenants, maintenance requests, payments, and related operations. The Platform is accessed via web browser at myrental.pro.

3. Accounts and Registration

To use MyRental you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@myrental.pro if you suspect unauthorized access to your account. We reserve the right to terminate accounts that contain inaccurate information or are used in violation of these Terms.

4. Subscription and Billing

MyRental is offered on a subscription basis. By subscribing, you authorize us to charge your payment method on a recurring basis at the rates in effect at the time of each billing cycle. Subscription fees are non-refundable except as expressly stated herein or required by applicable law.

We offer a free trial period as advertised. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period.

We reserve the right to change subscription pricing with at least 30 days' notice to active subscribers.

As a Client, you are responsible for:

MyRental provides tools to assist with property management but does not provide legal, financial, or real estate advice. You are solely responsible for your compliance with applicable law.

7. Payment Processing

Resident rent payments facilitated through the Platform are processed by Stripe, Inc. By enabling online rent collection, you and your residents agree to Stripe's terms of service and privacy policy. MyRental is not a party to payment transactions between Clients and residents and is not responsible for failed, disputed, or reversed payments. ACH payments are subject to NACHA operating rules.

8. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You grant MyRental a limited license to process data you input into the Platform solely for the purpose of providing the service to you.

9. Intellectual Property

MyRental and its licensors own all intellectual property rights in the Platform, including its design, code, features, and content. These Terms do not grant you any ownership rights. You retain ownership of all data you input into the Platform.

10. Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any feature or the Platform itself with reasonable notice. We are not liable for any losses resulting from service interruptions or modifications.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE OR THAT ANY DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYRENTAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless MyRental and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We may suspend or terminate your account and access to the Platform at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to access the Platform ceases immediately. You may request an export of your data within 30 days of termination; after that period, we may delete your data in accordance with our data retention policy.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Nebraska, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Douglas County, Nebraska, and you consent to personal jurisdiction in those courts.

16. Changes to These Terms

We may update these Terms from time to time. We will notify active Clients of material changes by email or by posting a notice on the Platform. Your continued use of the Platform after the effective date of changes constitutes acceptance of the updated Terms.
